Privacy Policy and Terms of Use
First, the ugly stuff. It's stuff we gotta say, no matter how annoying and redundant it is:
By signing up for an account on OpeningBands.com, you (the subscriber) certify that you are at least 13 years of age and/or have parental permission to do so.
SPAM POLICY:
Subscriber agrees not to use the forums or any other portion of OpeningBands for his/her own financial OR promotional gain except where deemed appropriate (ex: the "promote your band" forum).
Furthermore, subscriber agrees to abide by any and all rules posted on any area of the site by an OpeningBands administrator (ex: forum guidelines).
Subscriber agrees not to use personal information found on OpeningBands for any promotional reasons. This includes, but is not limited to practices such as
adding email addresses found on OpeningBands to mailing lists for bands, record labels, or any other entity. While we understand that those who sign up for
an account on OpeningBands are implying that they're probably interested in local music - if every band who signs up on here was allowed to email all of our
users, we'd all have WAY too much email to contend with. Therefore, expect to be banned if you do this or anything like it. If severe enough to really tick us
or our users off, also expect legal action.
DISCLAIMERS:
SUBSCRIBER EXPRESSLY AGREES THAT USE OF OPENINGBANDS.COM IS AT SUBSCRIBER'S SOLE RISK. NEITHER OPENINGBANDS, ITS AFFILIATES NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS OR LICENSORS WARRANT THAT OPENINGBANDS WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF OPENINGBANDS, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH OPENINGBANDS.
OPENINGBANDS.COM IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT
YOUR PRIVACY:
First and foremost, information we collect will NEVER be sold to any third party whatsoever without consent of any and all users it applies to. In simple terms: we're not giving anyone your email address, contact information, or ANYTHING, ever. We do reserve the right to do so, however, if you give us permission. This way, if we're offered $10 million for all the email addresses in our database, we can ask you if it's okay if we hook them up with yours. ;-) We will not disclose ANY information about any user of OpeningBands without their express consent unless we are required to do so by law, and provided official written documentation from a proper institution.
This site uses cookies as a means of identifying users and the state of being logged in, and other data necessary to providing the proper content (such as viewing a past issue) to the user. No personally identifiable data is stored in these cookies. However, failure to accept these cookies will make it impossible to use any of the features on OpeningBands.com that require you to be logged in.
We do collect usage statistics on OpeningBands such as which pages are viewed, the time they're viewed at, the browser and/or operating system they are using, and how a user arrived at that page (otherwise known as the "referer URL"). We use this data to determine the popularity, efficiency and value of various portions of our site. This data is not used for ANY purposes other than this sort of statistical analysis.
Your password is stored in encrypted form. As such, we do not have the ability to recover it for you. No member of the OpeningBands.com staff, or anyone else for that matter, has access to any means of determining the password of a given user.
If you choose to submit content to OpeningBands via email, regular mail, or any other means - we reserve the right to publish that content in its entirety or in fragments, so long as we provide credit to your name. All reasonable requests for content removal will be granted. If you do not want something you wrote posted here, we will most likely comply with your request. Exceptions include but are not limited to: you making a big ass of yourself and deserving humiliation, and.. hm.. that's all I can think of right now.
We reserve the right to "syndicate" content published on OpeningBands.com. This means that articles, reviews, or any other content posted here may be posted on other internet sites with our permission. Should you want any of your content to be exclusive to OpeningBands.com only - please specify this explicitly to us. We're your friends, we don't want to tick you off. But if we had to ask every person who has ever written anything for us if someone could quote them, we'd spend all our time doing that, and no time updating the site! You wouldn't want that, would you?
